Terms of Service

These terms govern use of Path to Sky, operated by Path to Sky, 2705 Burgundy Trail, Rowlett, TX 75088, United States (“we”). They form an agreement between us and the flight school that holds the account (“you”). By using the service you accept them.
The service
Path to Sky is software for running a flight school: scheduling, dispatch, maintenance tracking, and billing. We provide it as a hosted service. We do not operate aircraft, employ instructors, or supervise flights.
Accounts
You create your own account and choose your own password, and your administrators then create accounts for your own people. You are responsible for what the accounts you create do, for keeping credentials secure, and for removing access when someone leaves. Tell us promptly if you believe an account has been compromised.
Fees
Subscription pricing is per aircraft per month, at the rate agreed with you, and is billed monthly in advance through Stripe. Where a free trial applies, the subscription begins when the trial ends. Your aircraft count is the number of aircraft on your account, so adding or removing aircraft changes the bill from the next period.
Invoices are due within 30 days. We may suspend an account that remains unpaid after written notice. Fees already paid are not refundable except where the law requires it. We will give at least 30 days notice before changing your rate.
Payments your students make to you
Where you use the service to take payment from your students, those payments run on your own Stripe connected account and settle directly to you. We do not take a share of them and we never hold your money. Your use of Stripe is governed by your agreement with Stripe, and you are responsible for meeting its requirements, for refunds and chargebacks, and for the tax treatment of what you charge.
Your data
Your records remain yours. You grant us only the permission needed to host and process them so the service can work. We handle personal data as described in our Privacy Policy, which forms part of these terms. You are responsible for having a lawful basis to collect the personal data you enter, including the certificates and identification documents you upload about your people, and for telling them how it is used.
Acceptable use
You agree not to:
- Break the law with it, or use it to infringe someone else's rights.
- Try to reach data belonging to another school, or probe or interfere with the service's security.
- Resell or white-label the service without our written agreement.
- Upload malware, or automate access in a way that degrades the service for others.
Availability
We aim to keep the service available and to give advance notice of planned maintenance, but we do not currently offer a contractual uptime guarantee. The service depends on third parties including Supabase, Railway, Vercel, and Stripe, and their outages will affect it.
What this software is not
This is the part worth reading twice. Path to Sky helps you track scheduling, maintenance intervals, and certificate expiry, and it will warn you about conditions it can detect. It is not a substitute for the pilot in command's judgment, for a mechanic's sign-off, or for your own compliance with FAA regulations. Airworthiness determinations, currency, and the decision to fly remain entirely yours. Do not treat a green indicator in this software as authority to fly.
Warranties
The service is provided “as is”. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error free, or that the records it holds are complete or accurate, since they reflect what is entered into it.
Limitation of liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data. Our total liability arising out of these terms is limited to the fees you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Indemnity
You will defend and indemnify us against third-party claims arising from your use of the service in breach of these terms, or from the content and personal data you put into it.
Ending the agreement
You may cancel at any time, effective at the end of your current billing period. We may terminate for material breach that is not fixed within 30 days of written notice, or immediately where the law requires. On termination you can export your data, and we delete it after 90 days as described in the Privacy Policy.
Changes to these terms
We may update these terms. For material changes we will give at least 30 days notice by email to the account administrators. Continuing to use the service after that means accepting the new terms.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules, and the state and federal courts located in Texas have exclusive jurisdiction over disputes arising from them.
